1. Acceptance of Terms

By downloading, installing, or using the vibefits application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

vibefits is a virtual closet and outfit creation service that provides:

  • Photo upload and storage for your clothing items
  • AI-powered classification of clothing (brand, color, type, style)
  • AI-generated professional product photos of your items
  • Outfit creation and organization tools
  • Virtual try-on using AI image generation technology

The AI features provide approximations and may not be 100% accurate. Brand detection is based on visual analysis and may not always correctly identify items.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Content

You retain ownership of all photos and content you upload to the App. By uploading content, you grant vibefits a limited license to:

  • Process and store your photos to provide the service
  • Apply AI classification and image generation to your content
  • Create and store AI-generated images based on your content

You are responsible for ensuring you have the right to upload any photos and that they do not infringe on third-party rights.

5. Acceptable Use

You agree not to:

  • Upload inappropriate, offensive, or illegal content
  • Upload photos of other people without their consent
  • Use the virtual try-on feature to create misleading or harmful images
  • Attempt to reverse engineer the AI models or App functionality
  • Use the App for commercial purposes without authorization
  • Interfere with or disrupt the App's functionality
  • Use automated systems to access the App without permission

6. AI-Generated Content

The App uses AI technology (including Nano Banana) to generate:

  • Professional product photos from your clothing images
  • Virtual try-on images combining your selfies with outfits
  • Clothing classifications and style suggestions

AI-generated content is for personal use within the App. You may share generated images but must not represent them as real photographs or use them for deceptive purposes.

7. Intellectual Property

The App, including its AI models, features, and functionality, is owned by vibefits and is protected by international copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI CLASSIFICATIONS MAY NOT BE ACCURATE. VIRTUAL TRY-ON IMAGES ARE APPROXIMATIONS AND MAY NOT ACCURATELY REPRESENT HOW ITEMS WILL LOOK IN PERSON. BRAND DETECTION IS AUTOMATED AND MAY CONTAIN ERRORS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEFITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST DATA, LOST PHOTOS, OR INACCURATE AI CLASSIFICATIONS, ARISING OUT OF YOUR USE OF THE APP.

10. Indemnification

You agree to indemnify and hold harmless vibefits and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the App, content you upload, or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will cease immediately. You may request deletion of your data upon account termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting a notice in the App or sending you an email. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
